1. "AS-IS, WHERE-IS" SALE

All vehicles are sold AS-IS, WHERE-IS, with no guarantees or warranties, expressed or implied. All sales are final.

Lucky Auto Auction makes no representation as to the condition, mechanical soundness, safety, emissions compliance, or fitness for any purpose of any vehicle offered for sale. You are fully responsible for conducting all due diligence before placing any bid.

2. ELIGIBILITY & PREMISES RULES

• Bidders must be 18 years or older to participate.
• A valid government-issued photo ID is required to register and bid.
• No minors and no pets are allowed on the premises at any time.
• All attendees must follow the directions of auction staff at all times.
• Failure to abide by these conditions may result in immediate removal from the auction and loss of bidding privileges.

3. VEHICLE INSPECTION

• Inspection is open Thursdays from 12:00 PM to 2:00 PM, beginning two hours before the auction starts.
• Buyers may inspect vehicles on the day of the sale, before the auction begins.
• Test drives are not permitted.
• Tampering with vehicles is prohibited — including removing keys, starting vehicles without authorization, or altering mechanical components. Tampering is subject to vandalism charges under California Penal Code § 594.
• Lucky Auto Auction is not responsible for listing errors regarding year, make, model, mileage, or equipment.

4. BUYER FEES

The buyer fee is added to the final bid price. It is the same for every buyer and does not vary by buyer type.

The only additional auction fee is the optional Green Light fee ($50, non-refundable), charged when Green Light is offered and elected (see Section 11).

DMV, title, registration, sales tax, and emission fees are not auction fees and are the buyer's separate responsibility (see Section 10).

5. DEPOSITS — IN PERSON (CASH ONLY)

A deposit is required immediately after winning a bid:

• $300 deposit for winning bids under $2,000
• $500 deposit for winning bids of $2,000 or more
• Winning bids of $5,000 and above may require a higher deposit at the auction's discretion

In-person deposits are CASH ONLY. Deposits are non-refundable and must be made immediately after winning a bid. Failure to leave a deposit forfeits future bidding privileges.

6. PAYMENT & VEHICLE REMOVAL

Cash is not accepted for final balance payments. We do not accept full cash payment of outstanding balances at any location.

Payment windows (at the auction yard)

• Thursdays, 3:00 PM — deposits (cash) and balance payments (money order or cashier's check)
• Fridays, 9:00 AM – 1:00 PM — money orders and cashier's checks only

Payment deadline & removal

• The balance must be paid in full by 1:00 PM the following business day.
• If the balance is not paid within one business day, the deposit is forfeited and the vehicle may be resold.
• Vehicles must be removed by 3:00 PM the following business day.

Buyers are responsible for transporting and removing their own vehicles. Lucky Auto Auction is not responsible for theft, loss, or damage once the vehicle is sold.

7. ONLINE BIDDING DEPOSITS

To participate in online bidding, all users must maintain a valid deposit on their account.

• A minimum refundable deposit of $500 is required to activate bidding privileges.
• This deposit grants buying power of up to $10,000, based on a 10% deposit-to-power ratio.
• Deposits are fully refundable if:
  • No bidding activity or purchases have been made within 7 calendar days of placing the deposit, and
  • There are no pending payments or unpaid invoices linked to the account.
• Forfeiture: Bids are binding. If a user fails to pay an invoice in full within 3 business days of issuance, the deposit is forfeited and applied toward administrative and cancellation costs.

Use of deposits

• Deposits cannot be used to pay for vehicle purchases or applied to other invoices.
• Deposits are separate from payment and exist solely to establish buying eligibility.

By placing a deposit, you agree to these terms and acknowledge that failure to meet payment obligations may result in account restrictions, deposit forfeiture, or suspension of bidding rights.

8. BIDDING & AUCTION TERMS

Minimum bids & reserves

• Vehicles are auctioned with no minimum bid and no reserve, except for consignments carrying a reserve price.
• If a reserve is not met, the bid is classified as an "IF" bid.

"IF" bids (offers)

• An "IF" bid means the bidder agrees to purchase the vehicle if the seller accepts the offer.
• Offers remain valid until Friday following the auction.
• The sale is cancelled only if the seller declines the offer.
• If an offer is approved and the buyer fails to complete the purchase, the deposit is forfeited.

Bidder responsibility

• Buyers must confirm they are bidding on the correct vehicle. All bids are binding.
• If you are the highest bidder, you must complete the purchase. Failure to do so results in forfeiture of the deposit and of bidding privileges.
• Do not place bids if you do not agree with these rules. Bidding constitutes full understanding and acceptance of these terms.

9. MILEAGE DISCLAIMER

Vehicles 10 years or older are sold as "TMU" (True Mileage Unknown) unless otherwise announced. Lucky Auto Auction does not guarantee the odometer reading on any vehicle.

10. TITLE, DMV & REGISTRATION

• The buyer is responsible for title transfer, sales tax, registration, and all DMV fees.
• The buyer is responsible for all emission testing and emission-related repairs.
• Lucky Auto Auction does not process DMV paperwork.
• Title paperwork is processed after payment clears.
• Lucky Auto Auction is not responsible for errors in title documentation.

11. GREEN LIGHT (WHEN APPLICABLE)

Green Light is a limited, optional guarantee offered on select vehicles for a non-refundable $50 fee.

• Covers engine and transmission issues ONLY, for 30 minutes after purchase.
• A cancellation under Green Light must be approved by the Auction Yard Manager.
• If approved, the vehicle and all paperwork must be returned within 30 minutes, and the vehicle must not exceed 20 miles of test driving.
• The Green Light fee is not refundable under any circumstances.

12. LEGAL & LIABILITY NOTICES

Media waiver

By entering the auction premises, you grant Lucky Auto Auction permission to use your image, likeness, and video recordings for any promotional purpose. No compensation will be provided for media use.

Assumption of risk & release of liability

All individuals entering the premises assume all risks associated with attending the auction and release Lucky Auto Auction, its owners, employees, and agents from any and all liability related to personal injury, loss, or property damage.

Participation agreement

By registering, bidding, or otherwise participating in the auction — in person or online — you agree to all terms and conditions stated above. Do not place bids if you do not agree with these rules.
